By accessing or using Every No Counts ("the Service"), you agree to be bound by these Terms & Conditions. If you do not agree to these terms, do not use the Service.

Every No Counts is a web-based application designed to help salespeople track rejections and visualize progress toward their goals. The Service includes features such as rejection logging, goal tracking, streak counters, badges, and analytics.

3. Disclaimer of Liability

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

Every No Counts, its owners, operators, affiliates, employees, agents, and licensors shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages, including but not limited to:

  • Damages for loss of profits, goodwill, use, data, or other intangible losses
  • Damages resulting from the use or inability to use the Service
  • Damages resulting from any decisions made based on information provided by the Service
  • Damages resulting from unauthorized access to or alteration of your data
  • Damages resulting from any third-party content or conduct on the Service
  • Any loss of sales, business opportunities, or revenue, whether or not related to the use of the Service

This limitation of liability applies regardless of the legal theory on which the claim is based, including negligence, breach of contract, strict liability, or any other basis, even if Every No Counts has been advised of the possibility of such damages.

4. No Guarantees of Results

Every No Counts does not guarantee that using the Service will result in increased sales, improved performance, or any specific business outcome. The Service is a tracking and motivational tool only. Any results achieved are solely the responsibility of the user.

5. User Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

6. Subscription & Payments

Paid subscriptions are billed on a recurring basis (monthly or annually). You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. No refunds are provided for partial billing periods.

7. Data & Privacy

We collect and store data necessary to provide the Service, including rejection logs, goals, and account information. We do not sell your personal data to third parties. For more details, see our Privacy Policy.

8. Indemnification

You agree to indemnify, defend, and hold harmless Every No Counts and its owners, operators, affiliates, employees, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses arising from your use of the Service or violation of these Terms.

9. Limitation of Damages

In no event shall Every No Counts' total liability to you for all damages, losses, and causes of action exceed the amount paid by you, if any, to Every No Counts during the twelve (12) months prior to the claim.

10. Modifications to Terms

We reserve the right to modify these Terms at any time. Continued use of the Service after changes constitutes acceptance of the updated Terms.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States. Any disputes arising from these Terms shall be resolved in the courts of competent jurisdiction.
